RESOLUTION 8-16-2016 - Hope Online Learning Academy Co-Op Charter School Contract Amendment

RESOLUTION OF THE BOARD OF EDUCATION
OF
DOUGLAS COUNTY SCHOOL DISTRICT RE-1

CHARTER CONTRACT AMENDMENT
BETWEEN THE DOUGLAS COUNTY SCHOOL BOARD AND
HOPE ONLINE LEARNING ACADEMY CO-OP CHARTER SCHOOL

 

WHEREAS, on September 18, 2012, the Douglas County School District ("DCSD") entered into a five-year charter school contract ("Contract") with HOPE Online Learning Academy Co-op ("HOPE"), which contract expires on June 30, 2018;

WHEREAS, due to recent legislative changes and examination of state statutes by the office of the Colorado Attorney General, it is appropriate for HOPE to request certain non­ automatic waivers in order to be aligned with HOPE policies and practices, current law and State Board policy and rule;

WHEREAS, under recently adopted State Board rule, a request for standard non­ automatic waivers from state law requires the submission to the State Board the requested waivers and their replacement rationales, which are attached hereto;

WHEREAS, the State Board of Education, under the recent rule change, also requires that any additional waivers requested by a charter school that is currently under contract with a District be accompanied by a contract amendment acknowledging the requested additional waivers;

WHEREAS, the non-automatic waivers requested by HOPE are standard non­ automatic waivers commonly requested by charter schools throughout the State of Colorado and which are commonly granted by the State Board;

NOW THEREFORE, BE IT RESOLVED by the DCSD Board that the non­ automatic waivers attached hereto be included in the HOPE contract;

FURTHER RESOLVED, that all other provisions contained in the charter contract between HOPE and DCSD shall continue to be in full force and effect.
 

 Approved this 16th day of August, 2016, by a vote of 7-0.
